Township mulls no limit to number of medical marijuana facilities

KALAMAZOO, MI — Kalamazoo Township is considering allowing an unlimited number of medical marijuana facilities to open in its jurisdiction. The Kalamazoo Township Board of Trustees presented a first reading of a medical marijuana ordinance at a Monday, Nov. 13 meeting. If passed by the board after a second reading, the ordinance would allow people to begin the application process before the state begins granting licenses for five medical marijuana facilities on Dec. 15. It’s up to the state’s Department of Licensing and Regulatory Affairs to determine who is granted a license. Applications aren’t approved by Kalamazoo Township, but entrepreneurs have to receive a certificate from the Township Clerk’s Office to bring to Lansing. Supervisor Dexter Mitchell said the free market, township zoning requirements and the state will determine how many licenses are granted to medical marijuana businesses. It will be up to the applicant to determine if their business plan is tenable, Mitchell said. The township will not restrict medical marijuana facilities, he said, just like it doesn’t set a limit on the number of Walgreens or Wal-Mart pharmacies. Mitchell said he doesn’t want the township to get in the business of picking winners and losers. "It’s up to the business to do their market research," Mitchell said. "(If a medical marijuana facility) won’t be able to survive and go out of business that’s not on us, that’s on the business plan and your model … How dare us as a municipality try to dictate the market." The ordinance does not designate which zoning requirements apply to the facilities. This will be worked out by the township board and Planning Commission "as soon as possible," Mitchell said.
